On Tuesday, the United States Supreme Court handed President Trump and his Administration a victory, as he has continued to fight the crisis on the border regarding illegal immigration, drug cartels, human trafficking, child sex trafficking, terror, and criminals crossing the southern border!
The Supreme Court ruled that federal immigration authorities can detain immigrants awaiting deportation anytime after they have been released from prison on criminal charges.
The High Court ruled in a 5 to 4 decision that federal immigration officials can detain noncitizens at any time after their release from local or state custody, and that the government maintains broad discretion to decide who would represent a danger to the community in deciding who to release or detain.
The case involved a class-action lawsuit brought by non-citizens in California and Washington. The Plaintiffs in the case included mostly green card holders claimed that unless immigrants were picked up immediately after finishing their prison sentence, they should get a hearing to argue for their release while deportation proceedings go forward. On the other side, the Trump Administration argued that due to limited finances and manpower, which is primarily due to Congressional Democrat ‘resistance’, it is an impossible feat for the federal government to immediately detain every immigrant upon their release from custody.
Ultimately, the High Court reversed the lower court ruling and sided with the Trump Administration. Associate Justice Samuel Alito wrote the majority opinion, stating that
“neither the statute’s text nor its structure” supported the immigrants’ argument.
They also pointed out that both the Trump Administration and the Obama Administration argued against hearings for those who convicted of crimes that are affected by the law cited! Sadly though, once again, the radical left only has a problem with actions of an Administration if it is the Trump Administration, not Democrat Presidents!
